Delivery and Returns Policy

Article 1. About the Policy

1.1 This Policy regulates the principles and rules of delivery/returns of Iberia Food Company LLC (TIN  404992273) (hereinafter - KFC) products in case of ordering through digital channels.

1.2 KFC processes certain customer data on the basis and in the manner provided by law, in order to ensure the company's economic activity,  the proper functioning of the e-commerce program and the  delivery service for restaurant's customers. To do this, we may process the following data: first name, last name, e-mail address, mobile phone number, credit or debit card number, customer card expiration date.

1.3 This Policy and the rules for amending it shall be approved by the order of the Director of the Company.

 

Article 2. Purchase

2.1 If you wish to purchase an available product or service (“Purchase”), it may be necessary to provide information relevant to your purchase, including, but not limited to, the information listed in Clause 2 of Article 1 of this Policy.
You represent and warrant that: you have the legal right to use any card(s) or other payment method(s) in connection with any Purchase; and that the information you provide is true, correct and complete.
In order to make payments and purchases, we may use  a third-party service. By providing your information, you authorize us to provide that information to third parties subject to our privacy policy.
We reserve the right to refuse or cancel your order at any time for certain reasons, including but not limited to: product or service availability, errors in product or service description or pricing, errors in your order, or for other reasons.
We reserve the right to refuse or cancel your order if we suspect fraud or an unauthorized or illegal transaction.

 

Article 3. Product Returns and Product Replacement Policy

3.1 Subject to  the product value return and product replacement policy, you may  return the product immediately after receiving it or to exchange the purchased product in case it does not correspond to the product specified in the order and/or is obviously  defective.

3.2 If you wish to return the product, please immediately contact the relevant KFC branch where you have made the order and inform them of the return of the product. In this case, when ordering from kfc.com.ge or the KFC mobile application, the customer has access to the phone number of the specific KFC branch where the order was made.

3.3 In order to initiate the process, you need to inform the company: identification data of the product to be returned, order date, value  and proof of payment.

3.4 Product value return, product replacement policy applies immediately upon receipt of the product in case of obvious defects found upon inspection.

3.5 Product is replaced  (transported) by KFC through the contractors-aggregators, in case of a reasonable claim laid to a courier in respect of  the ordered products as provided for in clause 3.1 of this agreement.

3.6 KFC will return the product value in case of a reasonable laid  provided for in clause 3.1 of this Agreement.

3.7 The return of the sum is  possible only by non-cash payment by crediting the amount to the customer's bank account number through which the product order was made, and in the case of the customer paying the order value in cash, the sum may be returned  by crediting the amount to the bank account number provided by the customer to the relevant branch.

3.8 The product value may be return or the product may be replaced  in accordance with these rules if:

3.8.1 The product does not correspond to the order or the description posted on the website;

3.8.2 The product has an obvious defect;

3.8.3 The product is damaged during transportation.

3.9 KFC, in case of a customer's desire to return the value of the purchased product and replace  the product, taking into account the requirements of clauses 3.8 and 3.3 of this agreement, undertakes:

3.9.1 To fully return the value  of the ordered product to the customer, if the entire order is defective for reasons beyond the buyer’s control;

3.9.2 To resend the entire order to the customer, within the time agreed upon in advance, in the event that the entire order is defective for reasons beyond the buyer’s control; 

3.9.3 To return to the customer the  cost of the product lacking in the order, if the order lacks a certain type/quantity of products;

3.9.4 To resend the product lacking  in the order to the customer, in the time agreed in advance, if the order lacks a certain type/quantity of products;

3.10 KFC will reimburse the customer for the cost of the purchased products in the manner and amount established by this agreement within no more than 7 (seven) working days.

3.11 In the case of the buyer's request to replace  the products with the proper justification provided by this policy, upon delivery, the buyer shall  immediately report the incident to the branch where  the order was made, and after the branch confirms the customer's claim, the aggregators from this branch will be given a confirmation of the redelivery of the products to the customer.

 

Article 4. Content
Any visual and textual material posted to  our website is the property of or licensed to KFC. You may not distribute, modify, transmit, download, copy or use said content in whole or in part for personal commercial purposes or without prior written permission.

Article 5. Prohibited use
You may use the Service only for lawful purposes and in accordance with the Terms and Conditions.

Article 6. Analytics
We may use third party services to monitor and analyze the use of our Service.

Article 7. Accounts
By creating an account on our site, you acknowledge that the information you provide is accurate, complete and current at all times. Incorrect, incomplete or out-of-date information may result in immediate termination of your account.
You are responsible for maintaining the confidentiality of your account and password. You agree to be responsible for any and all activities or actions associated with your account and/or password. You must notify us immediately of any breach of security or unauthorized use of your account.
We reserve the right to refuse service, create  accounts, remove or edit content, or suspend orders at our sole discretion.

Article 8. Termination
We may terminate or suspend your account and access to the Service immediately, without a prior notice and free of any  liability, in our sole discretion, for any reason and without limitation, including but not limited to violation of the Terms and Conditions.
If you want to terminate your account, you can simply stop using it or delete your account yourself.
 
Article 9. Governing  Law
The Terms and Conditions are governed by and interpreted in accordance with the laws of Georgia, within the framework of the relevant regulatory law, without regard to conflicting provisions.
Our failure to enforce any right or provision of these Terms and Conditions shall not be deemed a waiver of such right. If any provision of these Terms and Conditions is held by a court to be invalid or unenforceable, the remaining provisions of these Terms and Conditions will remain in effect.

Article 10. Changes to the Service
We reserve the right to make changes to our service at our discretion. From time to time, we may restrict access to some or all of the Service to customers, including registered customers. 

Article 11. Confirmation/Consent
By using our service or any other service provided by us, you acknowledge that you have read and read these Terms and Conditions and agree to them.

Article 13. Order Delivery Policy

13.1 If the Buyer requests delivery of the order through the KFC service, the order will be delivered to the address indicated by the buyer on the https://kfc.com.ge/ website or in the KFC application. 

13.2 The Buyer shall  be able to receive calls on the phone number he /she specified at the time of ordering on the KFC website https://kfc.com.ge/. If the phone number provided by the Buyer cannot be reached, delivery may be canceled by KFC and the Buyer may be charged the full cost of the order.

13.3 The Buyer can specify that the order be delivered as quickly as possible (standard delivery method) or order in advance and specify a specific delivery time or order and come to pick up the order at a predetermined time.

13.4 Standard delivery method: the Buyer shall  be available  at the delivery address specified in the order from the time the order is placed to the time he/she  receives the products specified in the order. If the Buyer is not available  at the place specified by him/her  within 10 (ten) minutes after the delivery of the ordered products and the Buyer cannot be contacted after two attempts by the courier, the delivery will be canceled and the full amount will remain with KFC.

13.5 Pre-order delivery: in order to receive the order, the Buyer must be at the specified address during the time period starting ten minutes before the pre-order delivery time and ending at the time of delivery.

13.6 Delivery time  is the time of delivery of the purchased products or any other time notified to the Buyer through the KFC service is only an estimate. There is no guarantee that an order will be delivered at the specified time. Delivery times for products may be affected by factors such as traffic congestion, peak hours and weather.

13.7 The  delivery price is given on the order completion page. Delivery cost depends on order volume, delivery distance, traffic jams, peak hours and weather.

 

Article 14. Login Data
We inform you that when you visit the website, we collect information sent by your browser, called login data. This may include information such as your computer's IP  address, browser version, pages of our site visited, time spent on those pages, and other statistics.

Article 15. Links to Other Websites
Our website may contain links to other websites. If you use such a link, you will be redirected to the corresponding page. Remember that their functionality does not concern us, so please review their privacy policy. We cannot control and are therefore not responsible for the content, policies or practices of others' websites.
